Terms of Service
Welcome to Wicked Algo. These Terms of Service ("Terms") govern your access to and use of our website at wickedalgo.com, our trading indicators, our Discord community, our educational content, and any related products or services (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use the Services. By using the Services, you represent and warrant that you meet these requirements.
2. Account Registration
Some features of the Services require you to register an account through our checkout partner (currently Whop) and/or our Discord server. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
3. Subscriptions and Payments
Paid access to our indicators and premium Discord channels is offered on a subscription basis (monthly, annual) or as a one-time purchase (lifetime). All payments are processed by our third-party checkout partner.
3.1 Recurring Billing
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You authorize us (via our checkout partner) to charge your payment method on file for each renewal.
3.2 Cancellation
You can cancel a subscription at any time through your Whop dashboard. Cancellation takes effect at the end of your current billing period; you retain access until then.
3.3 Price Changes
We may adjust pricing from time to time. Price changes will not affect your current billing period. If we increase the price of your subscription, we will notify you by email before your next renewal.
4. License to Use Our Indicators
When you subscribe, we grant you a limited, non-exclusive, non-transferable, revocable license to use our indicators and related materials for your own personal trading use only. You may not:
- Share, sell, sublicense, or distribute our indicators, source code, or premium content to any third party
- Reverse engineer, decompile, or attempt to extract the source code or logic of our indicators
- Copy, modify, or create derivative works based on our indicators or course materials
- Use our indicators in any commercial product or service without prior written permission
- Share your account credentials or Discord access with anyone else
Violation of these license terms will result in immediate termination of your account without refund.
5. Discord Community Rules
Our Discord server is a community space. By participating, you agree to:
- Treat other members with respect
- Not share specific buy/sell recommendations as if they were financial advice
- Not promote or sell competing products, services, or signal services
- Not spam, harass, or post inappropriate content
- Follow all rules posted in the server
We reserve the right to remove members from the Discord at our discretion for violating these rules. Removal from Discord does not entitle you to a refund.
6. Intellectual Property
All content on the Services — including but not limited to indicator code, text, graphics, logos, videos, course materials, Discord content created by us, and software — is the property of Wicked Algo or its licensors and is protected by copyright, trademark, and other intellectual property laws.
7. No Financial Advice
The Services are for educational purposes only and do not constitute financial, investment, tax, or legal advice. See our Risk Disclaimer for full details. You are solely responsible for your own trading decisions and results.
8. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, Wicked Algo and its officers, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data, goodwill, or other intangible losses, arising from your use of or inability to use the Services.
Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Wicked Algo and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason including violation of these Terms. You may stop using the Services at any time by cancelling your subscription.
12. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will notify you by email or by posting notice on the website. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. Any dispute arising out of these Terms or the Services shall be resolved through binding arbitration in Cook County, Illinois, except that either party may seek injunctive relief in court to protect intellectual property rights.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
